Welcome to www.bizbuildhers.com (“Site”), owned and operated by Biz BuildHers, a South Carolina-based business consulting and marketing company. By accessing this Site or purchasing any of our services, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use our website or services.
1. General Provisions
- You must be at least 17 years old to access or use our Site.
- Use of this Site is at your own risk. We make no guarantees as to the accuracy, completeness, or safety of the content or services.
- These Terms are subject to change without notice. Continued use of the Site constitutes your acceptance of any modifications.
2. Services Provided
Biz BuildHers provides consulting, branding, website design, funnel development, marketing services, public relations, social media management, and executive virtual assistance. Services may be one-time or recurring. Scope, pricing, and deliverables are outlined in project proposals or invoices.
3. Client Responsibilities
Clients agree to:
- Provide accurate, timely information and assets for all projects.
- Respond promptly to communication and feedback requests.
- Review and approve deliverables within agreed timelines.
- Maintain responsibility for all content provided, including copyright compliance.
Failure to collaborate or provide information may result in project delays or termination.
4. Payment Terms
All services must be paid upfront unless otherwise agreed in writing. No refunds will be issued due to the nature of our work. If Biz BuildHers cancels a project, a partial refund may be issued at our discretion.
Late Payments:
If payment is not received within 15 days
of the due date, we reserve the right to suspend work or terminate the agreement. Late fees may apply.
5. Chargebacks & Payment Disputes
You agree that initiating a chargeback or payment dispute without first making a good-faith effort to resolve the issue with Biz BuildHers constitutes a breach of these Terms. All payments are final and non-refundable.
Unauthorized chargebacks may result in immediate termination of services, reporting to financial institutions, and legal action to recover lost funds, including legal fees and collection costs.
6. Project Pausing & Reactivation
If a project is paused for more than 14 consecutive days
due to client unresponsiveness, it will be placed on hold. A $150 reactivation fee
will be required to resume the project and reintegrate it into our schedule.
7. Ownership & Intellectual Property
- Clients retain ownership of all content they provide.
- Final design files are transferred to the client upon full payment.
- Biz BuildHers retains the right to display completed projects in its portfolio unless otherwise agreed in writing.
- Clients may not resell, sublicense, or reuse any of our deliverables (e.g., templates, funnels, or designs) outside the original project scope.
All creative assets and materials developed by Biz BuildHers remain our intellectual property until paid in full and may not be repurposed without permission.
8. Security & Assumption of Risk
You are responsible for safeguarding your account credentials. While we use secure third-party processors (e.g., Stripe), we assume no liability for breaches related to those platforms.
By using this Site or our services, you acknowledge and accept any risks associated with the information or materials provided.
9. Confidentiality
Biz BuildHers agrees to protect client confidentiality related to project details, proprietary strategies, and sensitive information. Clients agree not to disclose any confidential materials, strategies, or internal documents provided by Biz BuildHers. Confidentiality does not extend to publicly available or non-sensitive content unless otherwise agreed in writing.
10. Affiliate Disclaimer
This Site may use affiliate links to promote third-party products or services. We may earn a commission if you make a purchase through these links. You accept full responsibility for any decisions made through affiliate links on our Site or in our communications. We disclaim liability for outcomes related to third-party websites.
11. Force Majeure
We are not liable for delays or failure to perform due to events beyond our control, including but not limited to natural disasters, pandemics, acts of God, governmental restrictions, or communication outages. In such cases, timelines may be extended or services paused without penalty.
12. Communications Ownership
Any communications submitted through our Site (e.g., forms, blog comments, emails) are not confidential unless stated otherwise. We reserve the right to republish or reference communications in our marketing, unless prohibited by law or formal agreement.
13. Warranties Disclaimer

17. Termination
Either party may terminate the agreement at any time with written notice.
- If you terminate, payment is due for all work completed to date.
- If Biz BuildHers terminates due to breach of terms or lack of payment, any funds paid are non-refundable.
18. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of South Carolina. Any disputes will be resolved in the courts of Charleston County, SC.
Dispute Resolution:
Before pursuing legal action, both parties agree to attempt good-faith resolution through informal negotiation. If unresolved, disputes will be submitted to binding arbitration in Charleston County, SC, under the American Arbitration Association rules. Each party will be responsible for its own legal fees. Arbitration is the sole remedy for disputes, except those involving intellectual property or confidentiality.
19. Entire Agreement
These Terms represent the full agreement between you and Biz BuildHers concerning the use of our Site and services. They supersede any prior communications or understandings.
20. Earnings Disclaimer
We make no guarantees regarding income, growth, or specific business outcomes. Examples and testimonials are for illustrative purposes only. Your success depends on your effort, market conditions, and many other factors outside our control. You agree that Biz BuildHers is not responsible for your financial results or business performance.
